PERM was enacted by the Department of Labor in March 2005. It is an acronym for Ò Program Electronic Review Management SystemÓ. PERM replaces the old Labor Certification process, but in many ways they are similar. The process is designed to test the labor market to determine that there are not U.S. workers who are able, willing, available, and qualified to perform the job. U.S. workers are not to be displaced nor are wages or working conditions to be adversely affected. Employers are required to conduct recruitment through a series of steps. Advertising in a newspaper of general circulation on given dates, posting the job description with the State Employment Agency, posting the job requirements at the work place. The process can be demanding and time consuming. However, it does offer an individual with particular skills the opportunity to legally immigrate to the United States.
