Cancellation of Removal:

Cancellation of removal is a remedy available to individuals who: 1) Have been in the United States continuously for 10 years ( Brief departures may not affect relief );2) Is a person of Good Moral Character ( no serious convictions );3) His or her removal would be an unusual and compelling hardship on the parent, spouse, or children who are United States Citizens; or Lawful Permanent residents. This form of relief is usually a last resort effort to remain in the United States. The process can take anywhere from one (1) to three (3) years, during which time the individual can obtain work authorization, Social Security card, and Drivers license. Due to the complexity of this form of relief, an attorney is required to insure proper representation and knowledge of the pertinent regulations.
