All employers are required to fill out completely the I-9 questionnaire when hiring a new employee.

U.S. Immigration and Customs Enforcement ( ICE ) serves a ” Notice of Inspection ( NOI ) which is also known as an AUDIT. As well as the construction industry, other industries most likely to be audited are: Hotels and Restaurants, Manufacturing/processing food; power plants, airport employees and staffing agencies. The number of employees a particular business employs is not a factor. Any business may be audited.

The penalty for hiring undocumented individuals can vary. The amount can be anywhere from $200.00 to $2,300.00 per undocumented individual. The average penalty is $1,400.00 per I-9 form.

Also, if the I-9 form is not filled out correctly it can cause problems. If possible, the best way to complete the form is to use the “Smart” I-9 form which is available on the USCIS website.
